AuPairCare is part of Invasion Global LTD which is part of International Training and Exchange (Intrax) Global LLC, a US designated J-1 exchange visitor visa sponsor. AuPairCare is a cultural exchange experience and is there to enable a global understanding through shared participation, enabling friendships between Americans and the host families that welcome you as an au pair. You understand that by participating in cultural exchange and volunteering your time, you will receive a weekly stipend. The cultural exchange experience is facilitated by us being part of a J-1 designated exchange visitor visa sponsorship program. AuPairCare is not a temporary employment agency and should not be regarded as such. At no point are you employed by AuPairCare, and this program will not lead to a full-time position or qualification. Our role is to facilitate and support you on your cultural exchange journey, this is not a work placement, but is a cultural exchange.The purpose of this program agreement is to clearly detail our expectations of you as an au pair as well as to explain what you can expect from AuPairCare as your cultural exchange facilitator.

A. General Provisions AuPair is hereby advised and acknowledges that the parties agree as follows: 
1.Au  Pair  will  abide  by  the  terms  and  conditions  of  this  Agreement  for  the  duration  of  Au  Pair’s participation  in  the  AuPairCare  program,  unless  and  until  this  Agreement  is  replaced  or  modified  by  a subsequent written agreement executed by AuPairCare and Au Pair. 

2.Au  Pair  is  hereby  advised  and  acknowledges  that  all  Au  Pairs  are  participants  in  a  cultural  exchange program and agrees to comply with all the regulations published by U.S. Department of State in the Code of  Federal  Regulations,  part  62, as  the  same  may  be  amended  from  time  to  time  in  the  future. 3.Au  Pair  is  provided  the  opportunity  to  live  with  an  American  host  family  and  participate  directly  in  the home life of the host family. All au pair participants provide childcare services to the host family and are provided by their host family up to $500 to attend a U.S. post-secondary educational institution. Au pair participants provide up to forty-five (45) hours of childcare services per week and pursue not less than six (6) semester hours of academic credit or its equivalent during their year of program participation.

4.Au Pair understands their rights as visa participants under the Wilberforce Trafficking Victims Act. Rights And   resources   can   be   found   by   visiting:https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/temporary-workers.html

5.Au  Pair  represents  that  all  information  provided  throughout  the  application  process  is  true  and  that  no relevant  information  has  been  excluded or  misrepresented  in  the  application  process  and  documents, including representation of the level of English proficiency, health, driving and/or childcare experience. Au Pair agrees that all such disclosures will be full and accurate up to and through the date of departure from Au Pair’s country of origin.

6.Au Pair agrees to immediately amend any disclosures should new information become available to Au Pair in any regard or at any time of participation in the program. Au Pair represents that s/he will personally conduct all written and phone correspondence with Host Family during the interviewing process. Au Pair understands  that  exaggeration  or  falsification  of  any  application  information  by  Au  Pair,  references  or Originating Exchange Organisation may result in immediate dismissal from the program and return to Au Pair’s home country at Au Pair’s expense. 

7.AuPairCare has the right to determine suitability of Au Pair to participate in the program both before and during participation in the program. Au Pair agrees that in determining suitability, AuPairCare may make inquiries  to  third  parties  about  Au  Pair,  including  but  not  limited  to  medical  personnel  and  insurance agencies otherwise covered by federal HIPAA regulations.  

8.Au Pair understands that they cannot be married, engaged to be married,or have children of their own,and participate in AuPairCare’s cultural exchange au pair program.

9.Au Pair agrees to complete all visa screening requirements in accordance with the instructions given and will  be  responsible  for  obtaining  a  valid  passport  and  complying  with  all  vaccinations  and  immunization requirements.

10.Au  Pair  is  not  an  employee, agent,or  independent  contractor  of  AuPairCare,  and  AuPairCare  does  not exercise dominion or control over the actions of the Host Family.

Fees and Program Costs

11.Participation  in  the  AuPairCare  program  requires  Au  Pair  to  pay  a  non-refundable  program fee to the Originating Exchange Organisation.

12.Originating Exchange Organization may charge Au Pair additional fees to cover their administrative costs in promoting the Au Pair program and processing au pair applications. The fees may include, but are not limited  to,  an  application  fee,  processing  fee,  handling  fee,  and  interview  fee. These  fees  may  vary across Originating Exchange Organizations. AuPairCare assumes no duties or responsibilities for any acts or omissions of the Originating Exchange Organisation regarding additional fees.  

13.Au  Pair  will  be  responsible  for  additional  costs,  including  but  not  limited  to:  travel  to  and  from  the international gateway airport flights arranged by AuPairCare baggage check fees for all flights, meals on  arrival  day and  all  dinners while  at  the  Au  Pair  arrival  orientation,  medical  expenses  not  covered  by insurance and all incidentals and personal expenses while on the program. Au Pair should be prepared to cover these costs.

14.Au Pair  will  pay  all  applicable  fees  to the Originating  Exchange  Organisation  before  beginning  travel  to the United States. Au Pair may not under any circumstances solicit funds from Host Family to cover personal costs  of the program,  including not  limited  to  fees due  to  the  Originating  Exchange  Organisation,  costs associated with securing a visa, or incidental travel costs. 

15.Au  Pair  agrees  that  s/he  has  adequate  financial  resources  to  satisfy  all  obligations  as  an  AuPairCare  Au Pair, including payment for a return flight if Au Pair does not successfully complete the program.

16.Originating Exchange Organisation is not permitted to charge Au Pair a completion bonus, also known as a refundable deposit or bond.

Au Pair Cancellations/Flight Change Requests

17.Au Pair  agrees  to  pay  a  $300.00  USD  cancellation  fee,  plus  the  actual  cost  of  international  and/or domestic airfare, in the event he/she cancels their match or Au Pair program after matching with a family and prior to arrival at the host family home. 

18. Au Pair agrees to pay a $300.00USD change fee and any applicable airfare penalties in the event he/she requests to  change  their  arrival  date  confirmed  return  flight.Au  Pair  understands  that  AuPairCare cannot guarantee ability to accommodate flight changes or special requests.

19.Au Pair Agrees to pay a $300.00 USD change fee and any applicable airfare penalties in the event he/she fails to report to Originating Exchange Organisation least five days prior to au pair’s arrival date, any issue  preventing  au  pair  from  departing  as  scheduled  such  as a  visa  delay,  family  emergency,  or  other event.

20. Au Pair agrees to pay a £49 non refundable deposit. If your application is not accepted due to not meeting the requirements of the programme you will receive a refund. If you do not continue with your application for any other reason, the deposit will not be eligible for a refund.  

By signing up to AuPairCare cultural exchange programme you will receive: 
Customer service and support with your application prior to your departure. DS2019 form and SEVIS receipt (paperwork required for the US J-1 exchange visitor visa application), provided by Intrax who are a J-1 designated exchange visitor visa sponsor. Our best efforts to find and secure a placement as an au pair in the USA for you subject to following; this program agreement, Au pair  guidelines, compliance with all requirements including all US Department of State requirements for J-1 exchange visitor visa holders. By signing this program agreement, you understand that placement is not guaranteed.The $160 visa application fee is a third-party cost which is paid directly to the US Embassy. By signing up to this cultural exchange program and paying this fee, you will be entitled to attend a J-1 exchange visitor visa appointment (visa is subject to the US Department of State and US Embassy). AuPairCare  is not responsible for a lack of appointments at your chosen US Embassy or Consulate.24 hours a day, 7 days a week support from AuPairCare by Intrax who is also a J-1 designated exchange visitor visa sponsor, during your Au pair placement in case of an emergency.Return flights to and from the UK to America. Your return flight will only be included if you complete the full programme of 12 months. Should you leave the programme early, you will be responsible for covering the cost of your return flight home. Medical insurance for your Au pair placement. Once your placement is confirmed, you will automatically be enrolled onto our medical insurance, this is not something that can be exchanged for monetary value if you are unable to take part in the program. See the Medical Insurance section of this program agreement for more details. At your orientation you will be informed about medical insurance that applies to you.

What AuPairCare requires from you as the participant
To complete your application within a reasonable timeframe to ensure you have adequate time to have your application reviewed, your paperwork processed, and for you to complete your visa application. See the visa application section for more details on this.To provide all of the necessary documents to facilitate your visa application and upload these to your account: within 14 days of your placement being confirmed; This includes, but is not limited to, a copy of your passport, high school diploma, medical health check, ACRO police check and driving licenceIf you think that you will not complete the required documents in time, it is your responsibility to contact AuPairCare so that we can assess your individual circumstances. Similarly, if we are unable to contact you on the details that you provide in your application we will assume you no longer want to participate in cultural exchange. In either scenario – as there are limited places available and we are working on a first come first serve basis – we reserve the right to withdraw you from the program with no refund.You will complete an interview with an AuPairCare representative after completing your stage one written application. Your acceptance to the AuPairCare cultural exchange program is dependent upon a successful face to face interview. AuPairCare welcomes diversity and equality of opportunity, the interview process will test your suitability for the au pair programme and its requirements. It is also an opportunity for you to learn more about cultural exchange and what to expect from your exchange year. If you are unsuccessful in your interview we will process a full refund of your deposit.

Medical form  
AuPairCare requires all participants to complete the medical form provided to you on your AuPairCare portal. There are sections that can be completed by you and sections that need to be signed by a medical professional. This medical professional must confirm that you are able to safely participate in our program. Our parent company will also have to deem you are able to safely participate in our program.
You must make AuPairCare aware of any pre-existing medical conditions in your application. If AuPairCare as a US Department of State designated J-1 exchange visitor visa sponsor through our parent company or our partner, Intrax, thinks that any of your medical conditions will affect your ability to safely participate in our program we reserve the right to remove you from the program. At this stage we will issue you with a full refund if you are deemed unfit to participate in the program.Any pre-existing medical condition(s) will not be covered by the insurance policy you receive through Intrax via the AuPairCare portal You are responsible for obtaining additional insurance to cover you for any pre-existing condition(s). If you withhold any information about your pre-existing condition(s) from AuPairCare at this initial stage and it is discovered later in the application process that you are unfit to participate we reserve the right to remove you from the program without a refund.AuPairCare cannot be held responsible for any issues that arise from undisclosed pre-existing medical condition(s). Any fees incurred as a result of this will be your responsibility. If you are diagnosed with any medical condition after completing stage one of your AuPairCare application or after receiving your completed medical form, it is your responsibility to inform us before your placement begins. For the avoidance of doubt, this would be classed as a pre-existing medical condition.As you are participating in cultural exchange and volunteering with children and/or vulnerable individuals, if the USA requires you to have vaccines or tests prior to attending camp, this is your responsibility. This may include but is not limited to; TB tests, MMR vaccines, a negative COVID-19 test, COVID-19 vaccine(s), or (if required) an up to date COVID-19 passport. You may need to provide evidence to confirm that you have had these. AuPairCare cannot be held responsible for obtaining these, you must ensure any necessary tests or vaccines are obtained in a timely manner before you travel. If you do not have the required tests or vaccines, your host family may remove their match offer. If this happens, please contact the AuPairCare office as soon as possible and we will make you aware of the options you have. We may work to find you a new family, however, we cannot guarantee that any other families or USA itself will not require these tests or vaccines.AuPairCare are not responsible for any issue arising from the Department of State or local or national governments regarding COVID-19, testing or quarantine. It is your responsibility to ensure you have the correct category of test to enter the USA and have this taken within the required period of time set out by travel or country guidelines. If you are unable to take a test or test negative, AuPairCare cannot be held responsible, you must contact us immediately if you cannot travel due to changes in travel policies. In the event that you are diagnosed or has otherwise been in contact with someone who has been diagnosed with COVID-19 which results in you being unable to travel and/or are required to self-isolate, we cannot be liable for any refunds, compensation, costs, expenses or other losses of any kind incurred by you.

Criminal Background Checks 
We require you to detail any and all cautions, arrests and convictions to AuPairCare at the start of your application process. If you are unsure how to detail these, please contact AuPairCare so that we can assess your individual circumstances.If you fail to provide honest and accurate information at any stage of your AmeriCamp application, this could result in your application for a J-1 exchange visitor visa being denied. Any fees incurred as a result of this will be your responsibility. In the event of this you waive your right to a refund.If you are cautioned, arrested or convicted of anything after completing stage one of your AuPairCare application or after receiving your police background check, it is your responsibility to inform us before your placement begins. For the avoidance of doubt, we will reassess your eligibility to the program.We require you to apply for a background check through ACRO. ACRO police check is used for immigration purposes. We cannot accept a background check that you have obtained outside of ACRO. Information on how to apply for a background check can be found on your application portal when you reach the appropriate stage of the application.If you are applying from a country outside of the UK you will need to apply for the equivalent background check available from your home country. When you receive your background check, you must upload a copy to your AuPair account immediately.

J1 Exchange visitor visa process 
All participants must apply for a J-1 exchange visitor visa in order to take part in the AuPairCare cultural exchange program  in the USA. By signing the terms of this agreement, you agree to abide by all the rules and regulations of the J-1 exchange visitor visa as outlined by the US Department of State.As a part of the J-1 exchange visitor visa application process you will need to attend an in person interview at the US Embassy or Consulate in your home country or country of legal residence. Appointments are Monday to Friday, and are released by the embassy or consulate in line with demand at any particular time. Processes can vary throughout the season and any updates regarding the application process or the US Embassy or Consulate will be communicated to you as and when required.When you are ready to complete your visa application and book your visa appointment, AuPairCare will support you in this process.It is recommended by the US Department of State that all visa applicants attend an in person interview in their home country of citizenship or permanent legal residency. You understand that booking an outside of your country of citizenship or permanent residency may result in a higher risk of visa denial.In order to book your visa appointment you will need your DS2019 form to be processed. This document must be taken to your embassy or consulate for your appointment as proof of cultural exchange visa sponsorship.Our “personal information” application section must be accurate at all times, including any middle names on your passport. If your details change, please contact AuPairCare immediately.Your visa documents will be sent to the ‘mailing address’ on the “personal information” section on your application. You must contact AuPairCare immediately if this address changes. If you require a reprint of your DS2019 form for any reason, you will be responsible for the $100 fee to reprint. For this reason it is important that you take care of your form when you receive it and ensure details are accurate.Your $35 SEVIS fee to the US Department of State will be paid for you. We will provide you with instructions to download your SEVIS receipt once paid. This document must be taken to your visa appointment.You must not try to book your visa appointment before receiving your DS2019 and instructions from AuPairCare. Doing so could result in error, any fees incurred will be your responsibility.You are responsible for any costs associated with attending your US Embassy or Consulate, including but not limited to the fee the US Embassy charges for the appointment. You must take your passport to your visa appointment. Post-appointment, the US Embassy or Consulate will keep your passport for a minimum of 5-7 days before posting it back to you. Do not make international travel arrangements soon after your interview as you may not be able to travel. The US Embassy will either send your passport to you via their designated courier, or you will have the option to collect from a collection point they provide. AuPairCare is not responsible for any issues arising from this, you should contact the US Embassy or courier for assistance. If your J-1 exchange visitor visa application is refused at your appointment, contact AuPairCare immediately. You will have the option to rebook your visa appointment at an additional cost if you wish to do so. If the visa refusal is a final decision, AuPairCare cannot be held responsible for decisions made by a US Embassy, Consulate or representative of the US Department of State. AuPairCare cannot be held responsible for any refunds if a visa refusal is a final decision.

All Participants
If your application is withdrawn after your DS2019 has been delivered to you, you must return your DS2019 as soon as possible to AuPairCare.If you are notifying us of cancellation from the program, please call AmeriCamp and follow up in writing to info@aupaircare.co.uk with the subject “AuPairCare Cancellation”.Any costs incurred for third party fees, including but not limited to; your background check, your visa documentation fee, transport costs, flights and your J-1 exchange visitor visa interview, are non-refundable by AuPairCare.Except where otherwise expressly stated in these Booking Conditions, we will not be liable or pay you compensation if our contractual obligations to you are affected by any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination (including the ongoing effects of the COVID-19 pandemic), pandemics, epidemics or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or a supplier’s concerned’s control.Brexit Implications: please note that certain travel arrangements may be affected as a result of the United Kingdom’s decision to leave the European Union. This could include unavailability of certain flight routes, access to certain ports and airports and changes to the visa requirements for British citizens travelling to, within or through the EU. Please rest assured that this is something we will continue to monitor and we will advise our customers as soon as possible if we become aware of any confirmed bookings that will be affected. Since this is something completely unprecedented and outside our control, we would endeavour to provide suitable alternative arrangements where possible, however, we will not be liable to pay you any compensation.

AuPairCare policy 
Throughout the application process you must be honest with AuPairCare. All of the information you provide must be accurate in order for us to work with you to find you a placement. If it transpires that you were dishonest at any stage of the process, or withheld information from us that could affect our ability to place you, you may be removed from the program with legal action taken. In these circumstances we will not process refunds.Any behaviour that AuPairCare deems inappropriate, inaccurate or prejudicial (this will include on social media channels and any other publicly available information that you share) will result in your removal from the program. In the event of this you waive your right to a refund.As a part of our agreement with you, we will treat you with respect and work to overcome any challenges that may arise in your application process. We ask that you treat all of the AuPairCare staff with respect and consideration. Any behaviour that negates this agreement may result in your removal from the program. In the event of this you waive your right to a refund.

Data protection
By signing this form you agree that we can share the data from your application to third parties relevant in the application process and as part of Invasion Global. This may include but is not limited to, US camps who are considering your application, our parent company and our partner, IENA, also a designated J-1 exchange visitor visa sponsor, insurance companies, Camp.co.uk and government departments (in the USA and your home country).You are required to share sensitive information with us during the process. This includes but is not limited to; your medical and criminal history. In order for us to find you a placement at a Summer camp you agree to disclose this information honestly and in detail. Failure to do so may hinder our ability to place you. In this case we reserve the right to remove you from the program and you waive the right to a refund.We will also use the data you provide for facilitating your AmeriCamp cultural exchange volunteer placement.You agree that images and media taken or recorded of you at AmeriCamp events or during your placement at camp can be used for AmeriCamp marketing and promotional purposes.

Other terms and conditions
Au  Pair  understands  that  the  data  collected  via  the  au  pair  application  and  portal  is  or  can  be  made available to AuPairCare staff, host families and U.S. Department of State as required. Au Pair consents and authorities AuPairCare to use Au Pair’s name, photographs, file, application content, video  resume  (video  CV),  or  video  likeness  of  Au  Pair  or  any  comments  or  statements  from  host  in materials or publications to promote the AuPairCare program.Au  Pair  agrees  to  leave  the  United  States  within  30  days  of  the  conclusion  of  his/her  program. Au Pair understands that AuPairCare will not book a return flight that is more than 30 days past the program end date. Au  Pair  understands  that  any  stay  beyond  the  30-day  grace  period  is  a  direct  breach  of  the Regulations  of  the  Department  of  State,  and  that  Au  Pair’s future  ability  to  travel,  work  or  live  in  the United States may be compromised. Au Pair agrees not to enter into any kind of contractual agreement during the program year in the United States, including but not limited to business, employment, marital or religious contracts.Au Pair understands that AuPairCare is not a party to any agreement between Au Pair and the Originating Exchange  Organisation  located  in  Au  Pair’s  home  country. Au  Pair  acknowledges  and  agrees  that  the Originating Exchange Organisation is solely responsible to Au Pair for injury or damage from a violation of any  such  agreement. AuPairCare  assumes  no  duties  or  responsibilities  for  any  acts  or  omissions  of  the Originating Exchange Organisation..Au Pair agrees not to match with a Host Family outside of the AuPairCare portals..Au  Pair  understands  that  AuPairCare will  make  its  best, reasonable and  diligent  efforts  at  locating  and screening  all  Host  Families.  Au  Pair  agrees  to  assume  the  risks  involved  in  the  matching  with  a  Host Family and hereby  irrevocably, unconditionally,  and  fully  waives,  releases  and  forever  discharges AuPairCare,  its  subsidiaries,  officers,  employees,  and/or  agents  from  any  and  all  claims  related  to personal  and/or  property  damage,  injury,  loss,  delay  or  expense incurred  by  Au  Pair  or  any  guest, employee or agent, due to: (i) events beyond AuPairCare’s reasonable control, including without limitation acts of God, acts of war or government actions or restrictions.(ii) any events and/or acts directly or indirectly caused by any intentional or negligent acts or omissions at any time, in whole or in part, by any Au Pair and/or HostFamily or by any third party, including but not  limited  to  any  member,  guest,  employee  or  agent  of  the  Host  Family  or  other  persons  in the  host country, even if AuPairCare’s negligence is alleged to have contributed to the event, (iii)  risks  associated  with  foreign  travel  and  living  abroad,  including  but  not  limited  to  risks  associated with  health  care  services,  living  conditions,  sanitation  conditions,  road  and transportation  systems, criminal justice systems, civil liberty laws, customs and values, (iv) any differences in the living conditions and standards between Au Pair’s home and home country and the host home and host country, and, (v)any act or omission of the Originating Exchange Organisation.  In  this  respect,  Au  Pair  acknowledges  that  neither  Host  Family  nor  Au  Pair  are  an  employee  or  agent  of AuPairCare  and  actions  or  omissions  of  Au  Pair  or  Host  Family  are  not  to  be  attributed  in  any  way  to AuPairCare. Au  Pair  fully  agrees  to  assume  all  such  risks  and agrees  to  indemnify  and  hold  harmless AuPairCare,  its  subsidiaries,  officers, employees,and/or  agents  for  any  liability  or  expense,  including court costs and legal fees incurred, that Au Pair has in any way caused or contributed to, whether directly or indirectly, and whether intentionally or unintentionally.

These booking conditions are governed by the laws of England and Wales. You agree that any dispute, claim or other matter that arises out of this agreement will be resolved in courts of England and Wales only.
